By purchasing products from the Māori Television Merchandise online shop ("The Brand Owner or its agents"), the purchaser ("Customer") agrees to the following terms and conditions of sale.
Consumer Guarantees Act 1993: Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.
Business Customers: The Consumer Guarantees Act 1993 does not apply to business customers (where "business" is as defined by the Act). Business customers agree that where products are purchased for the purpose of a business that the Act does not apply.
Limitation of Liability: The “Customer” shall indemnify "The Brand Owner or its agents" against any loss of or damage to property or for data or product which is lost, corrupted, deleted or altered. "The Brand Owner or its agents" shall not be liable to the the “Customer” for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services, even if "The Brand Owner or its agents" has been advised of this possibility.
Refunds & returns policy
All Māori Television Merchandise is sold on a firm sale basis. We adhere to the Fair Trading Act and the Consumer Guarantees Act. Refunds are permitted under the following conditions:
- You can provide proof of purchase e.g. credit card statement or delivery docket
- There is a genuine reason for return
- The goods are returned in original condition to Māori Television at the customers expense
- We must be notified within 7 days of receipt of delivery and goods returned within 28 days
Faulty or damaged goods
If an item is faulty or damaged on receipt, we will happily exchange it. Exchange for faulty or damaged goods are permitted under the following conditions:
- We must be notified immediately on receipt of delivery/proof of purchase must be produced/faulty or damaged goods will be replaced.
PLEASE NOTE: As a standard quality practice all items are thoroughly inspected before being dispatched.
Addressing
If a product is found to be incorrectly addressed by "The Brand Owner or its agents" or its shipping agents, then "The Brand Owner or its agents" or its shipping agents shall be responsible for the re-delivery, replacement or refunding of the product. If the “Customer” is found to have given an incorrect or insufficient address, then Māori Television Merchandise or its shipping agents will not refund or resend the product and all responsibility for correcting delivery will be borne by the "Customer"
Incorrect or fraudulent bank credit card account number details
If the "Customer" provides or uses incorrect credit card details for the purchase of goods, then "The Brand Owner or its agents" will not accept any responsibility for correcting payment and the goods will not be dispatched. "The Brand Owner or its agents" reserves the right to not accept an order at any time from a "Customer".
Mailing cash
"The Brand Owner or its agents" will not accept any cash for payment of products. If the "Customer" does mail cash, "The Brand Owner or its agents" accepts no responsibility for the theft, loss or otherwise non-delivery of mailed cash.
GST
For New Zealand delivery addresses, all prices are GST inclusive unless otherwise stated.
